1. Introduction

Welcome to the Konbi website and related services operated by Mori Creation Company Ltd. (“Konbi”, “we”, “us”, or “our”).

These Terms and Conditions (“Terms”) govern your access to and use of our website, the Konbi mobile application if and when made available, any membership programme if and when offered, rewards, coupons, and promotions that may be introduced from time to time, and related products and services made available by Konbi.

By accessing or using our website or related services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or services.

2. Eligibility

You must be of legal age in your place of residence, or otherwise have the consent of a parent or legal guardian where permitted by law, to use our services and, where account registration is available, to create an account.

You are responsible for ensuring that your use of our website and services is lawful in your jurisdiction.

3. Account Registration

Certain features, if and when made available, may require you to create an account and provide accurate, complete, and up-to-date information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

We reserve the right to suspend or terminate accounts containing false, misleading, or incomplete information, or accounts used in breach of these Terms.

4. Membership Programme

Konbi may offer a paid monthly membership programme from time to time. If Membership is made available, it may provide benefits such as points accumulation, coupons, promotions, and other member privileges as determined by Konbi.

Any Membership, if offered, will be personal to the registered account holder, non-transferable, and will have no cash value.

5. Membership Fees, Renewal, and Cancellation

If Membership is made available, the applicable fees, billing cycle, renewal terms, cancellation process, and related conditions will be stated at the time of purchase or sign-up.

Unless otherwise required by applicable law, Membership fees, if charged, will be non-refundable except in cases of duplicate charge, technical error, or where a refund is required by law.

6. Points Programme

If Konbi introduces a rewards programme, eligible members may earn reward points (“Points”) through qualifying purchases made at participating Konbi vending machines or other channels designated by Konbi.

Unless otherwise stated by Konbi at the relevant time, a member may earn 1 Point per eligible purchase. A member may also earn 1 additional Point if the member wins an eligible game offered at the vending machine during that purchase. Points will only be awarded for successful, linked, eligible purchases, and may take a reasonable time to appear in the account.

Points, if offered, have no cash value, are non-transferable, are not redeemable for cash, and may only be used in accordance with the rules then in effect.

If a points programme is launched, the applicable redemption threshold, redemption value, eligible purchases, participating machines, usage limits, validity period, and expiry rules will be specified by Konbi at that time.

Konbi reserves the right to exclude failed transactions, refunded or reversed transactions, transactions not properly linked to the member account, fraudulent or abusive activity, unauthorised activity, and any purchases excluded by Konbi from time to time.

7. Game-Based Bonus Features

Some Konbi vending machines may from time to time offer a game or promotional challenge. Where available, members or eligible users may receive bonus Points or other promotional benefits subject to the applicable rules.

Not all machines or locations will offer games. Konbi may revise, suspend, or discontinue promotions, game availability, bonus mechanics, or related rewards at any time.

Konbi is not responsible for unavailability caused by machine malfunction, maintenance, connectivity issues, software error, or other service interruptions.

8. Coupons and Promotions

Konbi may from time to time issue coupons, vouchers, promotional offers, or other rewards.

Any such coupons or promotions will be subject to separate campaign terms, including expiry dates, usage conditions, product restrictions, participating locations or machines, redemption limits, and exclusions.

Unless otherwise stated, coupons are non-transferable, not redeemable for cash, and may not be used in conjunction with other offers.

Konbi reserves the right to modify, suspend, or withdraw coupons or promotions at any time, subject to applicable law.

9. Payments

Payments made through our website, app, or related services may be processed through Simple Pay and its supported payment channels or partners.

Konbi is not responsible for payment failures, delays, or interruptions caused by third-party payment processors, financial institutions, payment platforms, or network issues outside our reasonable control.

10. Product Availability and Machine Operation

Product availability, promotions, coupon use, rewards, points earning, and game features may vary depending on stock, location, machine condition, connectivity, maintenance, and other operational circumstances.

Konbi does not guarantee that all drinks, promotions, rewards, or features will always be available at every machine or at all times.

We may suspend services or temporarily disable purchases, rewards, redemptions, or features where reasonably necessary for maintenance, repair, upgrades, compliance, safety, or fraud prevention.

11. Food and Beverage Information; Allergies

Konbi aims to provide accurate ingredient and allergen information where reasonably available. However, ingredients, formulations, suppliers, and availability may change from time to time. Products may be prepared, stored, dispensed, or handled through shared equipment or in environments where allergens or other substances may be present. Konbi does not guarantee that any product is free from allergens, cross-contact, intolerance triggers, or substances that may cause adverse reactions in certain individuals.

Customers are responsible for reviewing any ingredient, allergen, and product information provided by Konbi and for determining whether a product is suitable for their own dietary, allergy-related, medical, or personal needs.

If you have any allergy, intolerance, sensitivity, medical condition, or uncertainty about whether a product is suitable for you, you should not purchase or consume the product without first obtaining appropriate advice.

12. Product Information and No Medical Advice

Product descriptions, promotional materials, ingredient references, and wellness-related content are provided for general informational and marketing purposes only.

Nothing on the website, app, or in Konbi materials constitutes medical advice, diagnosis, or treatment advice, nor does it guarantee any particular health outcome.

13. Complaints and Incident Reporting

If you experience an issue relating to a purchase, reward, coupon, billing event, machine operation, or product, you should contact Konbi as soon as reasonably possible and provide relevant details where available, including the date and time of the incident, machine location, item purchased, transaction screenshot or payment record, description of the issue, and any supporting photos or documents.

For non-injury complaints relating to billing, rewards, coupons, or machine service, Konbi requests that you notify us within 30 days of the relevant transaction.

This reporting timeframe does not affect rights that cannot lawfully be restricted.

14. Investigations and Record Preservation

In connection with complaints, suspected misuse, fraud, chargebacks, technical issues, or safety incidents, Konbi may review and preserve relevant records, including transaction logs, payment records, machine logs, maintenance records, redemption activity, and support communications, to the extent reasonably necessary for investigation, compliance, safety, or dispute handling.

15. Errors, Adjustments, and Fraud Prevention

Konbi reserves the right to investigate irregular activity and to correct any Points, coupons, balances, credits, or benefits wrongly granted due to system error, misuse, fraud, abuse, or unauthorised activity.

We may suspend, reverse, cancel, or adjust benefits, transactions, or accounts where we reasonably suspect fraud, abuse, technical manipulation, payment irregularity, or breach of these Terms.

16. Intellectual Property

All content, software, branding, text, graphics, logos, design, trademarks, and materials on the website or app are owned by or licensed to Konbi and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, reverse engineer, scrape, or commercially exploit any part of our website, app, or services without our prior written consent, except as permitted by law.

17. Acceptable Use

You agree not to use our website, app, or services for unlawful, fraudulent, or abusive purposes. You also agree not to interfere with the operation, security, or integrity of our systems, attempt to gain unauthorised access to any system or data, exploit bugs, automation, scripts, or workarounds to obtain unfair benefits, or impersonate another person or misrepresent your identity.

18. Disclaimers

Our website, app, membership programme, rewards, coupons, and related services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

Konbi does not guarantee uninterrupted availability, error-free operation, or continuous availability of all products, services, rewards, or features.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Konbi shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or related to your use of our website, app, membership programme, rewards, promotions, or related services.

To the fullest extent permitted by applicable law, where Konbi is found liable for a claim arising out of the website, app, membership programme, rewards, or related services, Konbi’s aggregate liability shall not exceed the total amount actually paid by you to Konbi for the relevant service during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death, personal injury, fraud, gross negligence, defective products, or other liability that cannot legally be excluded.

20. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Konbi, its affiliates, directors, officers, employees, agents, and service providers against claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the website, app, or services, your breach of these Terms, your fraud, or your violation of applicable law or third-party rights.

21. Force Majeure

Konbi shall not be responsible for delay, interruption, or failure in performance caused by events beyond our reasonable control, including payment processor failures, network outages, utility failures, supplier disruptions, natural events, public health events, cyber incidents, government action, labour disputes, vandalism, or machine damage.

22. Privacy

Your use of our website and services is also governed by our Privacy Policy.

23. Changes to the Website, App, or Programme

We may update, modify, suspend, or discontinue any part of our website, app, membership programme, rewards programme, game features, or promotional offerings at any time.

Where required by law, we will provide appropriate notice of material changes.

24. Changes to These Terms

We may revise these Terms from time to time. Updated versions will be posted on our website or app together with the updated “Last updated” date.

Your continued use of our website, app, or services after the revised Terms take effect constitutes your acceptance of the updated Terms.

本條款及細則規管你對我們網站、Konbi 手機應用程式(如日後推出)、會員計劃(如日後推出)、積分、優惠券及推廣活動(如不時推出),以及由 Konbi 提供之其他相關產品及服務的使用。

當你使用我們的網站或相關服務,即表示你已閱讀、明白並同意受本條款約束。

2. 使用資格

你必須已達你所在地之法定成年年齡,或在適用法律允許下已獲父母或合法監護人同意,方可使用我們的服務,並於帳戶註冊功能開放時建立帳戶。

你有責任確保你於所在地使用我們的網站及服務屬合法行為。

3. 帳戶登記

部分功能如日後推出,可能需你建立帳戶並提供真實、準確、完整及最新的資料。

你有責任妥善保管你的帳戶資料及登入憑證,並對所有於你帳戶下進行的活動負責。

如我們發現任何帳戶資料屬虛假、誤導、不完整,或帳戶被用作違反本條款之用途,我們有權暫停或終止該帳戶。

4. 會員計劃

Konbi 可不時推出按月收費之會員計劃。如會員資格正式推出,可能提供包括積分累積、優惠券、推廣活動及其他由 Konbi 不時決定之會員禮遇。

任何會員資格如有提供,僅限登記帳戶持有人本人使用,不可轉讓,亦不具任何現金價值。

5. 會員費、續期及取消

如會員資格正式推出,相關收費、計費週期、自動續期安排、取消方式及其他條件,將於購買或登記時列明。

除適用法律另有規定外,如收取會員費,有關費用將不設退款,惟重複扣款、技術錯誤或法律規定必須退款之情況除外。

6. 積分計劃

如 Konbi 日後推出獎賞計劃,合資格會員可透過於參與活動之 Konbi 販賣機或其他由 Konbi 指定之渠道完成合資格購買,以獲取獎賞積分。

除 Konbi 另有說明外,每次合資格購買可獲 1 分。如會員於該次購買時在販賣機提供之合資格遊戲中獲勝,可額外獲 1 分。積分僅適用於成功完成、已連結會員帳戶及符合資格之交易,並可能需要合理處理時間方會顯示於帳戶內。

積分如有提供,將不具現金價值,不得轉讓,不可兌換現金,並只可依照 Konbi 當時生效之規則使用或兌換。

如積分計劃正式推出,相關兌換門檻、兌換價值、適用購買項目、參與機台、使用限制、有效期及到期規則,將由 Konbi 於當時另行列明。

Konbi 保留權利排除交易失敗、已退款或被撤銷之交易、未有正確連結至會員帳戶之交易、涉及欺詐或濫用之活動、未經授權之活動,以及 Konbi 不時列明不適用之購買項目。

7. 遊戲額外獎賞

部分 Konbi 販賣機可能不時設有遊戲或推廣挑戰。如有提供,會員或合資格用戶可根據當時適用規則獲得額外積分或其他推廣獎賞。

並非所有機台或地點均設有遊戲功能。Konbi 可隨時修改、暫停或取消推廣活動、遊戲安排、額外獎賞機制或相關禮遇。

如因機器故障、保養維修、網絡問題、軟件錯誤或其他服務中斷而導致未能提供相關獎賞,Konbi 概不負責。

8. 優惠券及推廣活動

Konbi 可不時發出優惠券、電子禮券、推廣優惠或其他獎賞。

有關優惠券或推廣活動將受個別活動條款約束,包括到期日、使用條件、適用商品、參與地點或機台、兌換上限及其他限制。

除另有列明外,優惠券不得轉讓、不可兌換現金,亦不得與其他優惠同時使用。

Konbi 可在適用法律允許範圍內,隨時修改、暫停或取消優惠券或推廣活動。

9. 付款

透過我們網站、App 或相關服務之付款,可經 Simple Pay 及其支援之付款渠道或合作平台處理。

對於因第三方支付服務供應商、金融機構、付款平台或超出 Konbi 合理控制範圍以外之網絡問題而導致之付款失敗、延誤或中斷,Konbi 概不負責。

10. 商品供應及機器運作

商品供應、推廣活動、優惠券使用、獎賞、積分獲取及遊戲功能,均可能因應庫存、地點、機器狀況、網絡連線、維修保養及其他營運情況而有所不同。

Konbi 不保證所有飲品、推廣活動、獎賞或功能會於所有販賣機或任何時間持續提供。

如因維修、修理、系統升級、合規要求、安全考慮或防止欺詐而有合理需要,我們可暫停服務,或暫時停用購買、獎賞、兌換或其他功能。

11. 飲品資訊及過敏風險

Konbi 會在合理可行範圍內提供成分及致敏原資料。然而,原材料、配方、供應商及供應情況可能不時變更。飲品可能經由共用設備存放、調配、出品或處理,亦可能於接觸致敏原或其他物質之環境中處理。Konbi 不保證任何產品完全不含致敏原、交叉接觸風險、不耐受成分或可能引致個別人士不良反應之物質。

顧客有責任自行查閱 Konbi 提供之成分、致敏原及產品資料,並自行判斷產品是否適合其個人之飲食、過敏、身體狀況、醫療情況或其他個人需要。

如你有任何過敏症、不耐受、敏感反應、身體狀況,或不確定某產品是否適合你,你不應購買或飲用該產品,並應先尋求適當專業意見。

12. 產品資訊及非醫療建議

網站、App 及 Konbi 材料中之產品描述、推廣內容、成分介紹及與健康生活方式相關之資訊,僅供一般資訊及市場推廣用途。

上述內容並不構成醫療意見、診斷或治療建議,亦不保證任何產品會帶來特定健康效果。

13. 投訴及事故通報

如你就購買、獎賞、優惠券、帳單、機器運作或產品出現問題,應在合理可行情況下盡快聯絡 Konbi,並在可能情況下提供相關資料,包括事故日期及時間、機器地點、所購買商品、交易截圖或付款紀錄、問題描述,以及相關照片或證明文件。

就非人身傷害之投訴,包括帳單、獎賞、優惠券或機器服務問題,Konbi 建議你於相關交易後 30 日內通知我們,以便盡快調查及跟進。

上述通報時限不適用於法律上不得限制之權利。

14. 調查及紀錄保存

如涉及投訴、懷疑濫用、欺詐、退款爭議、技術問題或安全事故,Konbi 可在合理所需範圍內查閱及保存相關紀錄,包括交易紀錄、付款紀錄、機器日誌、維修紀錄、兌換活動及客戶支援通訊,以作調查、合規、安全或爭議處理用途。

15. 錯誤、更正及防欺詐

如因系統錯誤、濫用、欺詐、未經授權活動或其他異常情況而錯誤發放任何獎賞、積分、優惠券、餘額或利益,Konbi 保留調查及更正之權利。

如我們合理懷疑存在欺詐、濫用、技術操控、付款異常或違反本條款之情況,我們可暫停、撤銷、取消或調整有關利益、交易或帳戶。

16. 知識產權

網站、App 及其所有內容、軟件、品牌元素、文字、圖像、標誌、設計、商標及其他資料,均由 Konbi 擁有或獲授權使用,並受適用知識產權法律保障。

未經我們事先書面同意,你不得複製、轉載、修改、分發、逆向工程、擷取資料或以商業形式利用網站、App 或服務之任何部分,惟法律另有允許者除外。

17. 可接受使用方式

你同意不會將網站、App 或服務用作任何非法、欺詐或濫用用途。你亦同意不會干擾系統運作、安全性或完整性,不會嘗試未經授權存取任何系統或資料,不會利用漏洞、自動化工具、程式或其他方法不當獲取利益,亦不會冒充他人或虛報身份。

18. 免責聲明

我們的網站、App、會員計劃、獎賞、優惠券及相關服務均按「現況」及「可提供時」基礎提供,並在適用法律允許之最大範圍內作出。

Konbi 不保證網站、App 或任何產品、服務、獎賞或功能可持續不中斷、毫無錯誤地運作或持續提供。

19. 責任限制

在適用法律允許之最大範圍內,Konbi 對因你使用網站、App、會員計劃、獎賞計劃、推廣活動或相關服務而引致之任何間接、附帶、特殊、相應、示範性或懲罰性損害,或任何利潤、收入、數據、商譽或機會損失,概不負責。

在適用法律允許之最大範圍內,如 Konbi 被裁定須就網站、App、會員計劃、獎賞計劃或相關服務承擔責任,Konbi 對該等申索之總責任額,以你於引致該申索事件發生前 12 個月內實際支付予 Konbi 之相關服務費用總額為上限。

本條款並不排除或限制任何依法不得排除或限制之責任,包括但不限於因死亡、人身傷害、欺詐、重大過失、產品缺陷,或其他法律上不得排除之責任。

20. 彌償

在適用法律允許之範圍內,如因你濫用網站、App 或服務、違反本條款、作出欺詐行為,或違反任何適用法律或第三方權利,而導致 Konbi、其關聯公司、董事、高級人員、員工、代理或服務供應商蒙受任何申索、損失、責任、損害、成本或支出,你同意向彼等作出彌償並使其免受損害。

21. 不可抗力

如因任何超出 Konbi 合理控制範圍之事件,包括支付系統故障、網絡中斷、公用服務中斷、供應商問題、自然事故、公共衛生事件、網絡安全事故、政府行動、勞資糾紛、惡意破壞或機器損壞,而導致任何延誤、中斷或未能履行服務,Konbi 概不負責。

你使用我們的網站及服務亦受《私隱政策》約束。

23. 網站、App 或計劃之變更

我們可隨時更新、修改、暫停或終止網站、App、會員計劃、獎賞計劃、遊戲功能或推廣活動之任何部分。

24. 本條款之修改

我們可不時修訂本條款。更新版本將於網站或 App 內刊登,並標示更新後之「最後更新日期」。

We may also collect marketing and analytics information, including website and app interaction data, campaign participation data, push notification preferences, promotion response history, and analytics data relating to website, app, and rewards feature usage.

3. How We Use Personal Data

We may use personal data to provide and improve our website, app, and services, create and manage your account if account registration is available, process purchases and payments, operate rewards, points, promotions, or coupons if introduced, provide customer support, send service notices, account notifications, transaction messages, and promotional communications where permitted by law, conduct analytics and performance monitoring, detect, investigate, and prevent fraud, abuse, security incidents, safety issues, and technical problems, preserve records relevant to complaints, disputes, claims, or regulatory matters, and comply with legal and regulatory obligations and enforce our rights.

We may share personal data with payment service providers, including Simple Pay and its supported payment channels or processing partners, website hosting, app hosting, cloud storage, backend, and technical service providers, analytics, messaging, and customer support providers, vending machine operators or technical providers where needed to support purchases, maintenance, or incident investigation, legal, regulatory, judicial, governmental, or enforcement authorities where required by law or reasonably necessary to protect rights, safety, or compliance, and professional advisers, insurers, auditors, or dispute-resolution providers where reasonably necessary.

We do not sell your personal data to third parties.

5. Cross-Border Transfers

Your personal data may be stored or processed outside Macau where our service providers, cloud infrastructure, technical partners, analytics tools, or payment-related service providers operate.

However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

本私隱政策說明 Mori Creation Company Ltd.(下稱「Konbi」、「本公司」、「我們」)在你使用我們的網站、Konbi App、獎賞功能、推廣活動或相關服務時,如何收集、使用、儲存、分享及保護你的個人資料。

當你使用我們的網站、App 或服務,即表示你知悉並確認你的個人資料將按本私隱政策所述方式處理。

2. 我們收集的個人資料

視乎你如何與我們互動,我們可能收集的個人資料包括你的姓名或暱稱、手機號碼、電郵地址、如帳戶註冊功能開放時的登入資料、客戶服務訊息,以及你聯絡我們時提供之其他資料。

我們亦可能收集獎賞及交易資料,包括購買紀錄、如相關計劃推出時的獎賞、積分或優惠券紀錄、交易日期及時間、販賣機或地點識別資料、已購買商品、付款狀態、交易參考編號,以及退款、撤銷或拒付紀錄。

3. 我們如何使用個人資料

我們可能將你的個人資料用於提供及改善我們的網站、App 及服務,在帳戶註冊功能開放時建立及管理你的帳戶,處理購買及付款,如推出獎賞、積分、優惠或優惠券計劃時用於相關功能運作,提供客戶支援,在適用法律允許下發送服務通知、帳戶通知、交易訊息及推廣資訊,進行分析及表現監察,偵測、調查及防止欺詐、濫用、安全事故、安全問題及技術故障,保存與投訴、爭議、申索或監管事宜有關之紀錄,以及遵守法律及監管責任並保障我們的權利。

4. 我們如何分享個人資料

我們可能與支付服務供應商分享個人資料,包括 Simple Pay 及其支援之付款渠道或處理合作夥伴。我們亦可能與網站寄存、App 寄存、雲端儲存、後端系統及技術服務供應商、分析、訊息傳送及客戶服務供應商,以及為支援購買、維修或事故調查而需參與之販賣機營運商或技術供應商分享有關資料。

如法律要求,或為保障權利、安全或合規而有合理需要,我們亦可能向法律、監管、司法、政府或執法機關披露資料,並在合理所需範圍內向專業顧問、保險公司、核數師或爭議處理機構披露。

我們不會出售你的個人資料予第三方。

5. 跨境資料傳輸

你的個人資料可能會被儲存或處理於澳門以外地區,例如我們的服務供應商、雲端基建、技術夥伴、分析工具或付款服務供應商所在之司法管轄區。

我們僅會於為達成本私隱政策所述目的之合理所需期間內保留個人資料,包括維持業務及交易紀錄、處理退款、撤銷及爭議、調查投訴、事故或安全問題、保存與防止欺詐、法律申索、監管責任、會計、稅務及保安有關之紀錄,以及遵守適用法律。

當個人資料不再有需要時,我們將按適用法律要求刪除、匿名化或以安全方式保存該等資料。

7. 你的權利

在適用法律規限下,你可能享有要求查閱你的個人資料、要求更正不準確或不完整之個人資料、在適當情況下要求刪除個人資料、如處理基於同意時撤回同意,以及在法律允許範圍內反對某些資料處理之權利。

8. 市場推廣及推送通知

我們可能發送維持服務運作所需之通知。

在適用法律允許下,我們亦可能發送推廣訊息、優惠、活動更新、電子通訊及市場推廣推送通知。你可透過可用設定或聯絡我們以停止接收市場推廣資訊,但你仍可能收到必要之服務通知。

9. 飲品投訴及安全相關資料

如你就產品品質、安全或過敏相關問題作出通報,我們可能會收集及使用你提供之資料,連同相關交易資料、機器紀錄、地點資料、客戶服務通訊及其他相關紀錄,用作調查、風險審查、客戶支援、法律合規及爭議處理。

10. 資料安全

我們採取合理之行政、技術及組織措施,以防止個人資料遭未經授權存取、誤用、遺失、更改或披露。

然而,任何傳輸或儲存方式均不可能保證絕對安全,因此我們不能保證資料安全毫無風險。

11. 兒童私隱

除適用法律允許及已取得所需家長或監護人參與外,我們的網站、App 及服務並非為兒童而設。

我們不會在違反適用法律之情況下明知而收集兒童個人資料。
